Some of us like it and some of us don’t. BUT the EU is a very powerful source of consumer protections and national governments MUST ensure the EU laws are observed. Many of the consumer protections available to us exist in our national law because they arise from directives or regulations. Any national government within the EU is obliged to give FULL EFFECT to the consumer protections laid down in EU law. The Unfair Terms in Consumer Contracts Regulations (SI 2083, 1999) is a very good example of EU originated consumer protection legislation.
However, the application of these protections in our courts is woeful and that, of itself, constitutes a breach of Community law. Let your MEP know what is being done to you by Capstone.
Make them work for their money.
Encourage them to raise this issue at the highest level possible. They can even raise it with the Commission, which in turn can refer it to the European Court of Justice. Even our own Supreme Court can’t overturn their decisions.

Anyone may lodge a complaint with the European Commission against a member state about any state measure (law, regulation or administrative action) or administrative practice which he/she considers incompatible with Community law. However, the Commission’s services may decide whether or not further action should be taken on a complaint in the light of the rules and priorities laid down by the Commission for opening and pursuing procedures.
When the Commission decides to pursue a complaint the Commission allows the Member State to present its views regarding the facts stated in the complaint and the Commission’s initial legal assessment of them, through the letter of formal notice.
